The Polish regulations allow foreigners’ , national minorities’ or immigrant workers’ children education. The legal acts stress their right to preserve cultural identity, language, ability to organize own educational institutions and discrimination ban as well. From 19th of may 2009 some regulations of 1991’s Bill on the System of Education concerning non-Polish citizens are rearranged.


Article 94a of  paragraph 4 now says:

Non-Polish citizens obliged to study, whose language skills are insufficient to educate or who does not speak Polish at all, have a right to additional and free Polish as a second language lessons. The  lessons  are established by school’s administrative controlling organ.

What does it mean in practice?

City of Warsaw as  administrative controlling organ is obliged to provide and cover the costs of additional Polish as a second language lessons for Polish citizens obliged to study, who doesn’t speak Polish or  whose language skills are to weak to benefit from the education.
Additional lessons are organized for groups or  individually. The quality level of the class must be sufficient to allow the pupil to participate in the basic educational classes at least 2 hours a week.
The schedule for Polish lessons is established by the school headmaster. The additional Polish  lessons are free.



Article 94 paragraph 5a

Persons mentioned in the act #4 have right to assistance of  the  native-tongue speaker
employed by the headmaster as teacher’s support. The assistance lasts for no longer than 12 months. 

What does it mean in practice?

 The Ministry of  National Education (MEN) proposed the solutions for the better social inclusion of foreigners. The aim is realized by hiring native-tongue speakers to help both teachers and foreign students in integration. The assistance lasts for no longer than 12 months.



Article 94a paragraph 4c

The persons mentioned in paragraph  4 may attend the additional compensation courses in a range of subjects established by the  school  administrative controlling organ, but for no longer than 12 months.

What does it mean in practice?

City of Warsaw as an administrative controlling organ may establish a compensation course of the subject which a foreigner finds hard to learn. The need for equalizing the curriculum differences is reported on a teacher’s request. The additional lessons are established on the headmaster’s request and are free. Students attend one hour a week individually or in groups.
The total time of compensation course must not exceed 5 hours per week for each student.
The weekly schedule of the course is established by the school headmaster in cooperation with the. administrative controlling organ.



Article 94 paragraph 5

For non-Polish citizens obliged to study, the diplomatic mission (embassy or chancery) or cultural association of the particular country may establish education of the mother- tongue and culture of  the  nation. The permission of  the school’s administrative controlling organ  and the school’s headmaster is required.  The school is sharing the space for such class at no charge.

What does it mean in practice?

The foreign diplomatic mission (embassy or chancery) or the cultural association of the particular country may establish  class of the mother- tongue and culture of  particular nation for the foreigners subjected to obligatory education, if the amount of applying foreigners is enough, it means:

  • at least 7 students for primary and lower secondary schools
  • at least 14 students for artistic schools

A school is obliged to make the classrooms available. A total teaching time must not exceed 5 hours per week. The schedule for a foreign language and culture class is established by the school headmaster.
